At this point the deadline has passed for it to matter for bye-elections. If he was dead why wouldn't they just say so. The whole thing stinks, it hasn't made a lick of sense from the start.

This exactly it. Plus the Kentucky Governor said they're are loop holes they can use if he is dead, so they are delaying for as long as they can. Which likely means until the next GOP person can campaign and run for senator.

Could be brain dead and they are working on a technicality. Definitely have enough money and resources to keep a pseudo-corpse around for quite awhile.
