It's insane, but courts have interpreted "cruel and unusual" to require the punishment to be BOTH cruel AND unusual to qualify, and if the punishment is being administered in all prisons, it can't possibly be considered "unusual", so it gets a pass.

At least 50% of the statements from the Trump admin are rage-bait. Charlie Kirk, who's not even an elected official, caused a fair amount of backlash where people lost their jobs or were even imprisoned for their speech with little concern from conservative voters.
