That isn't the impression I'm getting from the article. It doesn't sound like it's something that's programmed into games themselves, as much as running on the operating system. If you take a look at the patent itself, it specifically mentions
I believe this is something that's primarily going to impact Microsoft store/Xbox purchases, if they do anything with it.
If it requires new games to send out pause screen triggers so it can overlay ads, I don't see why wine would have to do anything with them.
They’ll stop your word processor to send you an ad. Non native Linux apps won't cease this.
Nothing in the article or patent implies they'll be covering all applications you run on windows in ads. It's specifically just for listening for a system call signifying that a game is paused, and then overlaying ads while it's paused.
I think it sucks, I also think you're reading too far into it. Microsoft doesn't develop most windows software, and I'm not sure how you're expecting them to force every windows dev to incorporate ads into theirs. Wine/proton don't have to recreate the system library that serves ads on top of your games, to have it serve ads for Microsoft.
If it's a library that's bundled in with a game release (similar to DRM like denuvo), then that has to be done manually for every piece of software. I cannot imagine it being realistic that every single dev bundles it in that way, or that it would last long before cracked copies of games strip it out.
