It's "alleged" even though there's a verdict against them? That can't be right.

[–] lepinkainen@lemmy.world 68 points 1 week ago (4 children)

According to Bloomberg Law, Apple didn't agree with the jury's decision nor the damages and would appeal the verdict.

It’s alleged until the appeals stop, then it’s the final verdict

It's generally accepted that a jury verdict is final at the moment it's accepted by the trial court. So no "alleged" is needed. It's not technically wrong to use it as a descriptive choice, since it's now both factually established and still alleged, but it's misleadingly tentative and not required.

It’s alleged until the appeals stop, then it’s the final verdict

It's only alleged until the verdict drops. Whether or not they appeal, they are currently found guilty of the crime, ergo, not "alleged".

Apple is convicted of but alleges otherwise isn't that difficult.

[–] prettybunnys@piefed.social 1 points 1 week ago (1 children)

I believe the issue comes down to not needing to later retract things to change the statement, like yeah I know Apple was convicted of this and currently is “convicted” but if they appeal and win and in 5 years the article says “Apple convicted of X, must pay Y” you’d necessarily need a follow up article to correct it OR a retraction or whatever later.

Anyways. I bet that’s the reason, even if I agree that what you said should be the way it’s reported as it is currently the most accurate

So just more gutless journalism focused on appeasing corporate interest rather than reporting the truth? Shocking

[–] prettybunnys@piefed.social 1 points 1 week ago (1 children)

No that’s a pretty solid twist of my words

[–] gogonan@lemmy.world -1 points 1 week ago (1 children)

I mean it’s exactly what you’ve said. They hem and haw and refuse to report news that could warrant a future retraction—which, by the way, is a stupid take, as news is temporal and current and what they’re reporting currently is in the interest of some unknown future verdict rather than the one before us now. So, given that they choose to report whatever is most favorable for future corporate interest despite damning current events, I have to conclude that it’s because journalists are prevented from doing their actual jobs by media conglomerates who will always side with capital. How does that twist your words exactly?

[–] prettybunnys@piefed.social 1 points 1 week ago* (last edited 1 week ago)

You infer malice, by twisting my words, which I’m not doing.

Sometimes bad things happen for reasons that aren’t malicious, understanding that will help.

The same can be said about any crime though, right? If you're found guilty of murder, they drop the alleged and you're just a murder. If you successfully appeal, then the title is dropped.

You don't really have to say "alleged" if they've gotten a judgement against them in a court.

[–] aesthelete@lemmy.world 19 points 1 week ago (1 children)

Companies are considered innocent until...well, always I guess.

[–] tb_@lemmy.world 1 points 1 week ago

They might sue you into oblivion for one slip-up, better be vague always.

[–] chewypoops@lemmy.world 9 points 1 week ago

This is tech journalism, were you expecting integrity?

[–] ayyy@sh.itjust.works 55 points 1 week ago (3 children)

Patenting the idea of a vibrator is so fucking stupid. I hate this country.

[–] belochka@lemmy.world 21 points 1 week ago

I'm not sure rounded corners or a certain kind of icons are much better.

[–] Gonzako@lemmy.world 7 points 1 week ago

Previous steam controller died cuz of a patent troll

[–] Ertain@feddit.online 42 points 1 week ago (1 children)

For them, that may be pocket change.

[–] eleijeep@piefed.social 51 points 1 week ago (1 children)

From their last quarterly earnings report:

The Company posted quarterly revenue of $109.4 billion, up 16 percent year over year. Company gross margin was 50.1 percent

So the fine is less than a week of revenue.

[–] Goodlucksil@lemmy.dbzer0.com 11 points 1 week ago

Less than a week of revenue is not pocket change. If apple earned 2k a month, this fine would be 350

[–] NotMyOldRedditName@lemmy.world 16 points 1 week ago (1 children)

The Reuters article has this, which is interesting...

"Apple's Taptic Engine is fundamentally different from Taction's technology, which Taction's own testing of Apple's products confirmed during trial," Apple said in response

But im not seeing lots of details on easy searches. You're usually allowed to do something a different way though?

[–] Aatube@lemmy.dbzer0.com 1 points 1 week ago

something to potentially look into is the docket

[–] nothingcorporate@lemmy.today 11 points 1 week ago

| Apple is reportedly looking to appeal the jury verdict.

Yeah, no shit.

[–] Kissaki@feddit.org 5 points 1 week ago (2 children)

When will big companies lobby for patent law changes? I guess they still see enough value on the other end, with their own patents and lawsuits.

[–] ZILtoid1991@lemmy.world 1 points 6 days ago

They fo, it's just others benefit from the abuse

[–] LodeMike@lemmy.today 1 points 6 days ago

Big companies benefit the most from this

Let's be real , this is apple that we are speaking about... The won't add a fckin fingerprint scanner on you phone along side the face unlock, will shove through your throats the bugged Vibecoded slop of an os that ios liquid glass is with an eternity of bugs and also the Latest Mac OS Golden Gate, WIL NOT allow you to side load apps or even install one unless they are pain, Will take a fortune of your wallets to even give u a developer certification for the IOS softwares and MOST funny thing of ALL , WILL skip any major updates on hardware let alone their sloppy software after an entire goddarm years wait instead wasting time and revenue over some trivial sht as this patent.

The entire idea of this closed source nature needs to be overcome, don't think I am some android fan guy as i criticize their latest acts as well , they are following apple as well in their footsteps... At this point...the only thing which I loved the most important thing of Apple, ecosystem integration along with fine tuned software seems to be vanishing.....WHY would someone even consider them now? Reason: no one else comes close to them yet ... despite all these factors nothing comes close to them...MacOS bs linux isn't a question yet .. because sadly again arm systems of Linux are vastly in development...and their is no perfect widescale foss alternative to ios yet....

But one day we will outgrow them ...WE WILL
