It's not expensive if you make them work to pay for their room and board.
Sure that may be a bit like slavery, but true freedom requires a bit of slavery...
They wouldn't support locking the defendant up because there would be no public prisons. If you can't pay the plaintiff and court, then you're an outlaw and may be shot. There would be multiple courts, some of which overlap and conflict.
It may be more expensive to do it this way, but we get slaves out of it, so it all evens out
