so first, it definitely depends on the law, where i live downloading is perfectly legal, it is just uploading that is illegal.
second, how would they get list of downloading people? they would have to be uploading first and then saving a list of clients downloading from them, which is quite resource heavy activity, just checking who is offering something is far easier.
and as a person working for the isp in the past, i honestly don't remember deleting any complaints that someone was downloading something, all the complains were about upload.
so i think the answer to this question is definite yes, getting a complaint about download is like million times less likely
