It would be nice if officers received prison sentences for unlawful arrests. No bail, no parole, 1 year in prison for every unlawful arrests because it is just an abduction and violation of people's freedoms.
If an officer isn't sure someone is guilty of committing a crime they should be afraid to arrest them. Not a special prison either, the state penetentury with everyone else.
And resisting arrest should be an inviolable right – not a charge – as it's the definition of "life, liberty, and the pursuit of happiness".
Meh, I disagree with that. If officers were only arresting people they knew comitted a crime, and were punished for using excessive force, there really would be no reason to resist an arrest. Should be a put your hands out in front of you, they cuff your hands in front of you and you walk to the car. No reason to tackle anybody, no reason to cuff someone behind their back unless they truly are trying to resist which you'd see on all of the officers body cams. And I'd like it if officers had their guns in locked compartments like the center consol of their vehicle. Only removed if they are responding to an already violent crime, and any time it unlocked it must be documented and logged and reviewed by an outside company as to why a gun was necessary. Immigration charges aren't violent, stealing a TV isnt violent.
If you run, yeah the tackling becomes more necessary. But a woman in penis outfit... I mean come on. If she had actually done something wrong she isn't running anywhere, she's not fighting you.. just tell her to get in the backseat and drive her to the station/county jail to discuss it with the magistrate.
The magistrate should be like why the fuck did you arrest this person? Notify their supervisor they are on an immediate suspension pending an investigation of why they arrested someone for no reason, and the supervisor has to submit the body cam footage and get statements from everyone involved. And the 3rd party company that conducts the investigation asks a grand jury if it's worth having a criminal case against the officer. If half say yes, case should occur.
I’m not sure I fully agree with you. In theory, perhaps, but if there’s a killer on the loose I’d rather have a few questionable arrests than accidentally letting someone go free during an ongoing investigation.
But I’m not sure where that line is. We’re getting to a point where abuse of power arrests are becoming more and more common, and that I’ll agree needs some sort of deterrent.
It is better 100 guilty persons should escape than that one innocent person should suffer
The purpose of the police should be to protect the innocent, not to punish the guilty. When the police are victimize the innocent, they are not serving a useful function in society. In many cases when police arrest and charge an innocent person, they are leaving the guilty one free to further plague society.
In my opinion arresting someone who is a possible suspect in a murder investigation is a lawful arrest. The person arrested especially if they are treated with respect and "innocent until proven guilty", would likely agree that it was necessary as well. Ask them to put their hands in front of them, cuff them, ask them to get in the car and explain that they need to verify they weren't the culprit. Respect their time as much as possible and talk to them by basically saying I'm sorry we're having to do this, we just need to get the witness to verify you weren't the culprit, grab your prints and we promise we'll have you back to your day as soon as we can. If you need to notify your spouse or contact your work my partner will be glad to help you contact them while we ride down to the station. Blah blah blah
