I saw this video... He didn't even pick the clip up. He stands up and points it at everyone, then continues to stand for five or more minutes with the clip still not in.

The one on the ground came out of his vest pocket, there's still a magazine loaded, you can see it later in the video.

To be fair it would still shoot someone. Every gun should be treated as if a round is chambered, especially when pointed at someone.
