Named by whom? Is there a board? Wasn't it just his private company and therefore is now hers, or I guess their kids in a trust maybe?
It's a non-profit, which I believe always means incorporation, but not necessarily a board. In any case, you'd be an idiot to run such an outfit as a sole proprietor, both for tax and legal concerns.
