I think this actually happens when you do a speed test. Bittorrent being throttled? Hmm let me just run a speed te.. oh it's working now is it?

Sounds like someone should write a program that keeps a connection open to the speed test servers in the background to prevent throttling.

They do exist, but better programme might be changing your internet provider.
