TL;DR this isn’t even a “nuclear option”. It’s just “the option that was SOP for a long fucking time”. It’s only in contention now because the fascists want to be the only ones who are allowed to use said SOP, and don’t want their political opponents to have any agency whatsoever.
Standard conservative ideology: the law binds you, but not me. The law protects me, but not you. I can use the very same rule you're not allowed to use.
When was Beshear told he wasn't allowed to use this? By who? Unless a court told him no already he should have done this before even talking about it.
How is it in contention? Has Beshear even attempted this and been told no by a court or anybody?
The Republican controlled KY State legislature passed a law that requires a special election just before Democrat Beshear took office.
That state law didn't amend the state's Constitution tho.
FWIW I do believe that the "Conservative" stance here is the right one, more specifically that it should be the legal policy across every state. There's no logical justification for a governor having the unilateral right to appoint a successor to an elected office. Off season / special elections are not nearly the logicistical nightmare that they were even 20 years ago.
For every potential Beshear-Massie (read: based) situation, you can have what just happened in SC, where the governor (R) replaced Lindsey Graham's (R) seat with... Lindsey Graham's sister (R) because of... reasons.
We need to play by the current rules, not the ones we want to believe are just. Cause there already is the Lindsey Graham situation and they didnt need inspiration to do it.
Fighting back with hands tied behind our back cause we were told "its fair" doesnt look like fighting at all.
